Ex-client says law firm filed suit in wrong state, causing loss of $161M case
A former client has filed suit in Dallas against two Texas law firms and three attorneys, contending that earlier business litigation filed in the wrong state resulted in the loss of the $161 million underlying case.
Target Strike Inc. alleges that the defendants should have filed suit in the computer software dispute in Nevada, where a six-year statute of limitations applies, Texas Lawyer (sub. req.) reports. Instead, suit was filed in 2010 in Bexar County, Texas, where a four-year statute of limitations applies, and was dismissed on limitations grounds, the former client’s filing says.
Managing partner Dan Butcher of Strasburger & Price declined to discuss the pending litigation but said it plans to defend the negligence case. Another defendant, attorney Daniel Lanfear of San Antonio, told the legal publication the case has no merit.
Other defendants, including the Law Office of Donato D. Ramos, either didn’t respond to Texas Lawyer or couldn’t be reached.
